The Legacy of Vietnam Term Paper Example | Topics and Well Written Essays - 750 words
The Legacy of Vietnam - Term Paper Example The withdrawal of forces implied no direct involvement, but the US still planned to safeguard ââ¬ËSaigonââ¬â¢ through military and economic aid. Although Nixonââ¬â¢s regime uncompromisingly worked for ââ¬Å"Thieusââ¬â¢sâ⬠(South Vietnamese Premier) cause but because of certain issues raised by the US Congress, the aid to the South Vietnam was cut by half. Reduced aid further weakened South Vietnamââ¬â¢s position. This period was also marked by the premature resignation of President Nixon. The advance by the North Vietnamese communist army was swift and the conquest was completed in 1975. One of the prime implications of the conflict was economic. The war had brought a wave of inflation that the US had not witnessed in years with money flowing into Indochina for the ââ¬ËAnti Communistââ¬â¢ cause. Although the North Vietnamese were ostensibly victorious in unifying Vietnam, their victory was accompanied by the drainage of its State treasury. The country had b een ecologically damaged and all other institutions apart from the army had been moribund during the war years. The war had ironically turned Vietnam into one of the poorest countries of the world with fourth largest army in the world. The political implications were also major and they transcended the immediate region of Vietnam and also affected the proximal regions. The following chaos in Laos and Cambodia form an integral part of the ââ¬Ëlegacyââ¬â¢ of the war. The new unified Vietnam was facing its own problems with the culturally disparate north and south struggling to maintain a same national identity. In the post war years, America has made deliberate attempts to erase the lost Vietnam War from its consciousness. This made the veterans position rather flimsy as their efforts and sacrifices in the war were being rendered futile and meaningless by the public. This forced exclusion of Vietnam War has in a way alienated the war veterans who have suffered from isolation, dr ug abuse and many psychological disorders. Moreover, the views of the public on the war are very variegated which make the Vietnam War a fairly complex issue to understand. With the loss of the Vietnam War, the writer believes that the American policy makers have become more and more security conscious over the years. Taking the increased involvement of the USSR in the Afghan region as an example, the Americans spent millions of dollars on harnessing fundamentalist guerilla warfare in the region. Similar examples can also be seen in the leftist revolutions in the Central American region. The conclusion perhaps holds the crux of the article. The writer with the entire historical contextualization is trying to assert that the Vietnam War was in fact a paramount event in the history of international politics. It was marked with the exposure of the vulnerability of a Superpower that was far more superior militarily and economically from its opponent but had to suffer a humiliating defea t. The writer believes the contemporary world is not the world that was easily manageable by the imperial powers as in the 1940s. The political intervention of the powerful nations is not as easy as it used to be in the earlier half of the century when the superpowers defined the political map to suit their strategic interests. In the new era, America needs to accept its weaknesses and accommodate situations that might not be as palatable

The Lack Of Exposure And Practice Community
The Lack Of Exposure And Practice Community In Malaysia we have the Bahasa Malaysia as the national language but because of Malaysia is a multiethnic country, we have a variety type of language and dialect in the community (Eg : the Chinese community speaks Cantonese or mandarin and the Indian community speaks Hindi). People and student will tends to use their own dialect / language to speak among with their classmate due to they are more comfortable and fluency in speaking the respective language. It is also a fact that majority of the parent will talk to their children by using their own language instead of English (Hentan, 2011). As we are aware, practice makes perfect and therefore, English will need to be part of our life in order to be more fluent in the language. Education In the 1970s, teaching medium in national-type primary and secondary school was changed from English to Bahasa Malaysia. Due to this changes, Malaysian who studied in national-type school were less exposed to the English language as all important subject were being thought in Bahasa Malaysia except for the English language itself. Some students who continue their tertiary education in private institution only started to get full exposure of the English language as English is being used to teach in all subjects. Unfortunately, the sudden switch in teaching medium creates fear among the student who are weak in the language and therefore these students are afraid to communicate and interact during classes. While in public institutions, Bahasa Malaysia was continue as a medium of instruction and unluckily, these group of students did not even get any chance to expose themselves in the English Language. According to Teoh (2011), academicians are not surprise that proficiency in English am ong local graduates are at a declining stage as students were less exposed and lack of foundation in English language. 310 words The awareness of English importance. Many of the students do not know the important role of English language in today society and student study and memorize English just to pass the exam in education. Hence, students self developed a bad attitude towards learning the language and makes them not interested to explore and obsess in the language. It was mentioned by Teoh (2011) that the status of English decreased to such a level that it became simply a subject of study like other subjects such as history, geography, and physics and another reason is the lack of emphasis on English as it now not a compulsory subject to pass Students need to understand that most of the sources or information related to science, business, technology and medicine are mostly written in English. Therefore, before a student can grasp hold of the related industrys information, they will need to have powerful command in English. Gooch (2009) mentioned that student does not aware the importance of English until the enter the working world and these lead to student unwillingness to lean proper English language. We need to face the fact that many important knowledges is in English and we cannot really convey certain concept in other languages. 203words Lack of well trained English tutor. Quality old teachers who have a lot of exposure to the English language is retiring gradually. These teachers is being replaced by new and younger teacher which have less exposure to the language and experience. This is certainly true as we are aware that many young graduates could not get hold to a good command in English. Apart from that, there will be young graduates enter the education industry and become and English teach. Therefore, It is not a surprise that most local English teacher now are not equip with the proper skill and knowledge to teach English language. Nowadays, local English tutor often use bilingual methods while teaching in English classes. A English teacher will try to explain in mother language when a student is confused or do not understand during classes. This is a wrong attempt and methodology used as view by English Language Teacher (ELT) specialist, said Kannan (2009). A English teacher has to encourage students to speak in English only during classes. Wit h this, the student will only start to learn while making mistakes and student will be more confident in using the language It is also mentioned by Dr. Khalid (2012) that Teaching languages require skills, competence, training, and thorough knowledge. Thus, it seems foolish to assume that just because someone speaks English he can teach it effectively. Languages is very important in terms of accent, pronunciation, grammar and vocabulary. A teacher without these knowledge might lead to student having the wrong understanding in the language. 257 words Language influenced by nowadays trend it is inevitable that English language is part of the modernization process where nowadays students tend to make changes to the grammars while sending messages through mobile phone, computer or using other communication hardware. These changes basically involve shortening of words by conveniently leaving out vowels and leaving out conjunctions as reported by quicksand (2012). In addition, some words even replaced with digit when the pronunciation of the particular word spell or sound similar to the numbers. Below is an example of nowadays trend in messaging Immediately, the trend of shortening messages is widely influenced and accepted by people around the world due to it would save up individual time having to spell out every single word or letter. As this have been adopted by most student, mastering English in grammar and spelling will become a problem for these students as they are used to write in such a way. 186 words

Defining Social Media Essay
In my opinion, social media is used to keep in touch with people, share ideas, videos, and pictures, and gain some knowledgeable information in networks and virtual communities. Social media is very handy when it comes to keeping in touch with long-lost friends and family members. Social media is a great resource to search things that you donââ¬â¢t know and that allows you to become knowledgeable about things you needed to know. Article Selected: Vineââ¬â¢s Biggest Teen Star Criticized for Homophobic Video Response: My response to this article is that you should always watch what you put on social media because anything can be saved and it could generally be held against you depending on what the post may be about. Social media isnââ¬â¢t always a personââ¬â¢s best friend. You need to watch what you post; especially for employer reasons. Majority of employers will go onto your Facebook page and see what kind of a person you really are. In this certain article, Nash Grier is a very popular person on Vine. After he posted the video making a homophobic slur, he did delete it because of negative comments that started to begin. The trick to this though, is that he deleted it, but someone else had already saved it and posted it again and it went viral. After that, Nash Grier did take it upon himself to apologize on Twitter saying how he was being ignorant, stupid, and how he was stuck in a bad place. He may have apologized, but from here on out, itââ¬â¢s possible that this discrimination will be held against him for life, due to one mistake he didnââ¬â¢t think about before he posted it on social media. Conclusion: Think before you post. You should always know that whatever you post on social media, may or may not affect you in the long run. Be smart and think about what youââ¬â¢re posting before you actually submit it. Citation: Vineââ¬â¢s Biggest Teen Star Criticized for Homophobic Video. (2014, July 8). Analysis of the Play Equus Essay
With its minimalistic set design, small cast, and a stage with nearly no lighting, Peter Shafferââ¬â¢s play Equus relies heavily on a masterfully written script to spread its message with the audience. The play is ââ¬Å"neither great theatre nor bad psychology, but it has elements of bothâ⬠(Witham). With the assistance of the character Martin Dysart, a child psychologist, the play analyzes the parental, religious, and sexual reasoning behind the heinous act of a sick boy (Alan Strang) and calls for Dysart (along with the audience) to question and reevaluate their ideas of passion and freedom. While the discoveries occur slowly throughout the entirety of the play the largest impact comes from interaction with Alanââ¬â¢s parents, Dysartââ¬â¢s monologues, and the climactic scene of Act II. There is no denying that the interactions with and between a childââ¬â¢s parents have a large impact on shaping the childââ¬â¢s mind and morals and who that child will ultimately become (Shumaker & Heckel, 39). Sex and religion were crucial factors in Alanââ¬â¢s childhood development due in no small part to the incompatibility between his parents. His mother, a Christian from an upper class ââ¬Å"horseyâ⬠family who married beneath her, shared religion and fanciful horse stories with her son. His openly atheistic father refuses to allow his sonââ¬â¢s religious worship explaining his own views of Christianity as ââ¬Å"just bad sex (Equus, Location 530)â⬠. He further implies connections between religion and sexual desire when he reports to Dysart his observations of Alan: ââ¬Å"A boy spends night after night having this stuff read into him: an innocent man tortured to death- thorns driven into his head-nails into his hands-a spear jammed through his ribs. It can mark anyone for life, that kind of thing. Iââ¬â¢m not joking. The boy was absolutely fascinated by all that. He was always mooning over religious pictures. I mean real kinky ones, if you receive my meaning. (Equus, Location 530)â⬠. When his religious ââ¬Å"fixationâ⬠was blocked, it forced Alan to transfer his ââ¬Å"ââ¬â¢normalââ¬â¢ social views of sex and worship onto his pagan, equine religion (Busiel)â⬠. His having been denied the freedom of religion by his father and having his image of the crucifixion of Christ replaced with that of a horseââ¬â¢s head, is the most probably catalyst that began Alanââ¬â¢s strange pagan-like worship of the Horse-God Equus. As strange and twisted as Alanââ¬â¢s worship of horses may have seemed, Dysart could not deny the raw passion behind it-a passion he both greatly lacked and envied. In the process of understanding Alan, Dysart is forced to make a painful discovery of his self. He is stuck in a lifeless, childless marriage of ââ¬Å"antiseptic proficiencyâ⬠, ââ¬Å"sustained only by his fascination with Ancient Greek mythology (Rooney)â⬠. He is made aware of his hunger to be someone instinctive, passionate, and capable of being transported by worship the way Alan is (Rooney). Dysart tells the audience of a dream he had where he was a chief priest in Homeric Greece sacrificing hundreds of children as a ritual to bring good fortune to the land, with every child he begins to feel more nauseous and worried that he may be discovered. He saw Alanââ¬â¢s face on every victim (Equus, Location 290). One could simply deem this a nightmare and be done with it but in truth it brings to light Dysartââ¬â¢s fear that by curing Alan he will also be hurting him. One of the final, and arguably most powerful, scenes of the play unfolds as Dysart is finally able to draw from Alan what happened the night he blinded the horses. After a failed attempt to see a pornographic movie together Alan and Jill (one of the stable hands) returned to the stable for a ââ¬Å"roll in the hayâ⬠at Jillââ¬â¢s request. Feeling the eyes of Equus upon him, Alan is unable to perform. He can see and feel nothing but Equus: ââ¬Å"When I touched her, I felt Himâ⬠¦ When I shut my eyes, I saw Him at onceâ⬠¦I couldnââ¬â¢t feel her flesh at all! (Equus, Location 2300)â⬠. The ultimately unsuccessful attempt at a normal relationship with a girl causes Alan to feel not only the shame of having failed as a man but also shame from having desecrated his temple of horses. The horsesââ¬â¢ staring eyes become unbearable. Alan and Dysart both become the voice of Equus, mocking and berating Alan both for his failure and for even attempting to escape from Equusââ¬â¢ eyes: ââ¬Å"I see you. Always! Everywhere! Forever! Kiss anyone and I will see. Lie with anyone and I will see. And you will fail! (Equus, Location 2346)â⬠. Unable to stand it anymore, Alan takes the hoof pick and stabs out the horsesââ¬â¢ eyes with a final cry of ââ¬Å"Thou-God-Seest-nothingà ! (Equus, Location 2364â⬠). In his final speech, Dysart tells that he will ââ¬Å"cureâ⬠the boy and erase all traces of Equus from his mind. He will remove Alanââ¬â¢s pain and give him a ââ¬Å"normalâ⬠life. In his farewell to Alan he shows at just how high a cost normalcy comes: ââ¬Å"You wonââ¬â¢t gallop any more, Alan. Horses will be quite safe. Youââ¬â¢ll save your pennies every week, till you can change that scooter for a car, and put the odd 50p on the gee-gees, quite forgetting that they were ever anything more to you than bearers of little profits and little losses. You will, however, be without pain. More or less completely without pain. (Equus, Location 2433)â⬠. Despite the consequences, Dysart finally accepts his assigned role as a healer because all of the alternatives are unacceptable (Witham). In the end Equus leaves the audience with the question of whether satisfying the demands of those around us is worth losing important pieces of ourselves such as our passion and freedom in all its forms (religious, sexual, etc. ). True, Alan will be better once he is cured and Dysart may come to terms with his life and learn to appreciate what he has but the entire situation could have been avoided had Alanââ¬â¢s parents allowed him to decide rather than forcing their contrasting views on him. We can make do one way or we can thrive another.

The term represents what is known as virtuous resentment which emerges from a sense of claim with regards to impartiality and desert. This is aroused in individuals by the thought of achievement without merit besides a consequential pleasure that arises from the punishment of the individual who is unjustifiably prosperous1 . Thumos Thumos can also be spelt as thymos. Thumos is an ancient Greek word used to denote the concept of spiritedness. For instance, it was used to portray a spirited argument or debate. Thumos was also used to indicate a physical relationship with either blood or breathe and also denoted an individualââ¬â¢s desire to be recognized. Plato, in his work known as Phaedrus and other works, described thumos as one of the prominent components of psyches. Plato stated that thumos was an emotional constituent of virtue. It influenced some of the feelings experienced by people; for instance, the feeling of fear and anger2. Physis The term physis is a Greek term used in relation to philosophy, theology and science. In English, the term was translated to mean nature. Physis was used as a synonym for the word natural. This stemmed from the etymology of the term physical. In more details, physis lexically connoted phyein; phyien was used to imply growth in ancient Greece. The Greeks gained knowledge of physis through introductory noetic and poetic knowledge of being3. Nomos Nomos is an ancient Greekââ¬â¢s philosophical model of law. The model became common during the late 5th century and early 4th century BC when the Greek Sophists were deeply concerned about the political authority on one hand and also that of the rights, freedom and specific obligation of citizens on the other hand.Advertising Looking for coursework on philosophy? Laws were placed under the nomos; this was because laws were generally regarded as emanating from human inventions achieved through consent for the reason of limiting the natural freedoms for the benefit of pragmatism and personal interests4. Phronesis Phronesis is an antique Geek term denoting wisdom. It was also used to refer to intelligence. Both wisdom and intelligence are terms commonly used in philosophy. According to a theory regarding Aristotleââ¬â¢s rhetoric, phronesis is one amongst the three kinds of appeal to an individual character. This is commonly referred to as ethos. Phronesis, as used, was more concerned with specifics because it influenced how an individual acted in a given situation. Aristotle emphasized that for one to be virtuous phronesis is both sufficient and necessary5. Mimesis Mimesis is a Greek terminology with a number of meanings attached to it. The term is both philosophical and critical; its meanings include mimicry, imitation and representation. Mimesis is an ancient Greece idea used to govern the creation of artistic works with connection to the material world which was understood to be a model for good, truth and beauty. Plato contrasted the term mimesis with diegesis. However, after Plato, mimesis had numerous other interpretations. Aristotle also had a n interpretation of what mimesis was. He wrote about mimesis as the exactness and simulation of nature6. Arete This is also a Greek word used by ancient Greeks to mean excellence of any sort. This meaning was tied to the concept of realization of a purpose or objective. It was used to describe the action taken by an individual to realize a full potential. In ancient culture of the Greeks, arà ªte was considered to be strength and audacity. In fact, the term arà ªte was used by ancient Greeks to mean something related to being the best one could be in the process of realizing the goals of life. Therefore, arà ªte could be interpreted to mean virtue used in achieving practical results7.Advertising We will write a custom coursework sample on 10 Terminologies of Philosophy: Nemesis, Thumos, Physis, Nomos, Phronesis, Mimesis, Arà ªte, Kairos, Aidos and Eupsychia specifically for you for only $16.05 $11/page Learn More Kairos Kairos is another ancient termino logy used in reference to an appropriate moment. The ancient Greeks used both chronos and kairos to refer to time. However, chromos was mostly used to refer to chronological time while kairos was used to refer to a time frame; a period of indefinite time in which an incredible thing happened. Comparing the two, chronos was quantitative in nature and kairos was qualitative. Besides, both modern and ancient Greek philosophers have used the term kairos to refer to weather8. Aidos Aidos is a term that was used to refer to the deity spirit of humility, respect and admiration. Aidos was a companion to a deity known as nemesis. As a form of quality, Aidos was a specific feeling of respect or disgrace which barred men from committing wrongs. Nemesis, as discussed earlier, represented righteous resentment awakened by the sight of the iniquitous living in unmerited good destiny. Aidos was seen by the ancient Greeks as a personification of humility. She was worshipped both by the Greeks and th e Romans9. Eupsychia Eupsychia is a Greek term that stemmed from the Greek roots eu implying good and psyche implying the soul. Given this, eupsychia means the good society. The term was used by the ancient Greeks to imply the society of good community members. Eupsychia was considered as a vision of utopian society. It was coined by Maslow to describe a community in which health, self actualization and balance of life are enhanced. Conclusion This paper identified and discussed ten terminologies. These terminologies include nemesis, thumos, physis, nomos, phronesis, mimesis, arà ªte, kairos, aidos and eupsychia. The terminologies were predominantly used by the ancient Greeks. Alien and Sedition Acts Essay Example
Alien and Sedition Acts Essay Example Alien and Sedition Acts Essay Alien and Sedition Acts Essay Government 22 October 2012 Alien and Sedition Acts In 1798 the United States was involved in an undeclared war with France. ââ¬Å"The United States again stood on the brink of war with a major European power, only this time instead of Great Britain the hostile nation was France. â⬠(Hay 141) Later on the Federalist Party passed a series of four laws which were called the Alien and Sedition Acts and the Federalists saw foreigners as a deep threat to American security. There were a series of four acts that were adopted to alienate aliens. The first of these acts was the Naturalization Act which was passed by Congress on June 18. This act required that aliens be residents for 14 years instead of 5 years before they become eligible for United States citizenship. The second major act was the Alien Act which authorized the President to deport aliens who were dangerous to the peace and safety of the United States during peacetime. Furthermore the third act was the Alien Enemies Act which allowed wartime arrest, imprisonment and deportation of any alien from an enemy power. The last of these acts was the Sedition Act which consisted of, if there was any treasonable activity, including publication of any false or scandalous writing was wrong and punishable by fine or imprisonment. These acts helped to assist the governments sense of security for the United States. Although the government accepted the acts, people like James Madison were against for what the acts stood for. To protest the Alien and Sedition Acts, the Virginia and Kentucky Resolutions were written to show that the acts were unconstitutional in the since that any acts of Congress that were not authorized by the Constitution and violated on the reserved powers of the states. Stating that the federal government canââ¬â¢t create new powers for itself and it must be approved by the states of the people. The second major act that was approved was the Alien Act and itââ¬â¢s stated in Section 1, ââ¬Å"That whenever there shall be a declared war between the United States and any foreign nation or government, or any invasion or predatory ncursion shall be perpetrated, attempted, or threatened against the territory of the United States, by any foreign nation or government, and the President of the United States shall make public proclamation of the event, all natives, citizens, denizens, or subjects of the hostile nation or government, being males of the age of fourteen years and upwards, wh o shall be within the United States, and not actually naturalized, shall be liable to be apprehended, restrained, secured and removed, as alien enemies. And the President of the United States shall be, and he is hereby authorized, in any event, as aforesaid, by his proclamation thereof, or other public act, to direct the conduct to be observed, on the part of the United States, towards the aliens who shall become liable, as aforesaid; the manner and degree of the restraint to which they shall be subject, and in what cases, and upon what security their residence shall be permitted, and to provide for the removal of those, who, not being permitted to reside within the United States, shall refuse or neglect to depart there from; and to establish any other regulations which shall be found necessary in the premises and for the public safety: Provided, that aliens resident within the United States, who shall become liable as enemies, in the manner aforesaid, and who shall not be chargeable with actual hostility, or other crime against the public safety, shall be allowed, for the recovery, disposal, and removal of their goods and effects, and for their departure, the full time which is, or shall be stipulated by any treaty, where any shall have been between the United States, and the hostile nation or government, of which they shall be natives, citizens, denizens or subjects: and where no such treaty shall have existed, the President of the United States may ascertain and declare such reasonable time as may be consistent with the public safety, and according to the dictates of humanity and national hospitality (Finkelman 368). The act stated that in time of war, the President of the United States has the right to take action against any person who was a citizen of the country the United States was at war with. The President was given the power to act against the citizens of that country who were at war with the United States, as long as the person was a male, not a citizen of the United States, and at least fourteen years old. The Sedition Act was approved by Congress on July 14, 1798. It differed from the Alien Act; the Alien Act affected all United States citizens and not only the aliens. The Alien Act was also clearer that if a person is being convicted of any crime against the United States. Furthermore, the Sedition Act was designed to protect the Federalist and the President from ââ¬Å"falseâ⬠and ââ¬Å"maliciousâ⬠statements with the power of speaking. It didnââ¬â¢t protect the Vice President Thomas Jefferson or the Republicans. The act stated in Section 1 of the Sedition Act, ââ¬Å"to impede the operation of any law of the United States, or to intimidate or prevent any person holding a place or office in or under the government of the United States, from undertaking, performing or executing his trust or duty, and if any person or persons, with intent as aforesaid, shall counsel, advise or attempt to procure any insurrection, riot, unlawful assembly, or combination, whether such conspiracy, threatening, counsel, advice, or attempt shall have the proposed effect or not, he or they shall be deemed guilty of a high misdemeanor, and on conviction, before any court of the United States(Finkelman 369). Furthermore in Section 2 of the Sedition Act states, ââ¬Å"And be it farther enacted, That if any person shall write, print, utter or publish, or shall cause or procure to be written, printed, uttered or published, or shall knowingly and willingly assist or aid in writing, printing, uttering or publishing any false, scandalous and malicious writing or writings against the government of the United States, or either house of the Congress of the United States, or the President of the United Statesâ⬠¦. then such person, being thereof convicted before any court of the United States having jurisdiction thereof, shall be punished by a fine not exceeding two thousand dollars, and by imprisonment not exceeding two yearsâ⬠(Finkelman 369). The Federalist Party used the Sedition Act to prosecute Jefferson supporters, journalists, congressman, and other critics of the Federalist Party. The act clearly states that any treason towards the United States will not be tolerated, and the person responsible for the crime will be punished. In addition, Section 2 of the Sedition Act states anything written or negatively published material that is intended towards the United States is a crime, fined, and will be punished by the court. An example of a violation of the Sedition Act was a Matthew Lyon who was a Representative of Vermont. His letter criticized President Adam; ââ¬Å"unbounded thirst for ridiculous pomp, foolish adulation, and self avariceâ⬠(ââ¬Å"Sedition Act Trialsâ⬠) which caused Matthew Lyon to be imprisoned. The Federalists sent Mr. Lyon to prison for his opinions and was later reelected by his constituents for Congress while he was still currently still in prison. If then freedom of speech, means in the Constitution, the privilege of speaking any thing without controul, the words freedom of press, which form a part of the privilege of printing an y thing without controul. â⬠(Hay 143) Matthew Lyon was accused of speaking without control through the press. It clearly violates the first amendment in infringing on the freedom of the press and abridging the freedom of speech. Many followed and argued that it violated the Bill of Rights prohibition against laws ââ¬Å"abridging freedom of speech or of pressâ⬠. In Section 3 of the Sedition Act, ââ¬Å"That if any person shall be prosecuted under this act, for the writing or publishing any libel aforesaid, it shall be lawful for the dependant, upon the trial of the cause, to give in evidence in his defense, the truth of the matter contained in Republication charged as a libel. And the jury, who shall try the cause, shall have a right to determine the law and the fact, under the direction of the court, as in other cases. (Finkelman 369) This section states the courts roll in providing the guidelines of a fair trial or investigation. The Sedition Act was a product of the governments fear of the situation the United States was in. The government needed to protect the United States from inside the Nation while they were still at war with France. The Sedition Act was very influential because it restricted the First Amendment right to criticize the President and Congress and criticism of government policy and government officials. Obviously the Sedition Act was clearly violating the individual protections and freedom of speech under the first amendment of the Constitution. The Alien and Sedition Acts were not a complete success with the United States as a whole. It had sparked the first extensive debate in American History on the meaning of the First Amendment and of freedom of speech and press. Thomas Jefferson called the Alien and Sedition Acts ââ¬Å"an experiment on the American mind to see how far it will bear all avowed violation of the Constitution. â⬠Thomas Jefferson and James Madison helped draft the Virginia and Kentucky Resolutions which both protested the acts through the Kentucky and Virginia Resolutions. That the General Assembly of Virginia, doth unequivocally express a firm resolution to maintain and defend the Constitution of the United States, and the Constitution of this State, against every aggression either foreign or domestic, and that they will support the government of the United States in all measures warranted by the former. That this assembly most solemnly declares a warm attachment to the Union of the States, to maintain which it pledges all its powers; and that for this end, it is their duty to watch over and oppose every infraction of those principles which constitute the only basis of that Union, because a faithful observance of them, can alone secure its existence and the public happinessâ⬠¦ (Encyclopedia of American History Documents 454) The Virginia Resolution used the idea of ââ¬Å"interpositionâ⬠by the states. Resolution stated that when the government acts beyond their limits of the Constitution, the states have the rights to take action and appeal it. The first Kentucky Resolution, which was passed by the state legislatures in November of 1798, stating that the federal government had no right to exercise powers not specifically delegated to it. If the federal government took on such powers, its acts could be declared unconstitutional by the states. Passed by the Senate, Virginia sent their resolution in December of 1798. The Virginia Resolution was carefully written document stating Virginias difference with addition of the Alien and Sedition Acts that they are unconstitutional and clearly Virginia did not support either of the two acts. One year later Kentucky sent their second resolution protesting the Alien and Sedition Act. Approved by the Senate in December of 1799, Kentucky stated, The representatives of the good people of this commonwealth in general assembly convened, having maturely considered the answers of sundry states in the Union, to their resolutions passed at the last session, respecting certain unconstitutional laws of Congress, commonly called the alien and sedition laws, would be faithless indeed to themselves, and to those they represent, were they silently to acquiesce in principles and doctrines attempted to be maintained in all those answers, that of Virginia only excepted. To again enter the field of argument and attempt more fully or forcibly to expose the unconstitutionality of those obnoxious laws, would, it is apprehended be as unnecessary as unavailing. We cannot however but lament, that in the discussion of those interesting subjects, by sundry of the legislatures of our sister states, unfounded suggestions, and unhanded insinuations, derogatory of the true character and principles of the good people of this commonwealth, have been substituted in place of fair reasoning and sound argument. Our opinions of those alarming measures of the general government, together with our reasons for those opinions, were detailed with decency and with temper, and submitted to the discussion and judgment of our fellow citizens throughout the Union. Whether the decency and temper have been observed in the answers of most of those states that have denied or attempted to obviate the great truths contained in those resolutions, we have now only to submit to a candid world. Faithful to the true principles of the federal union, unconscious of any designs to disturb the harmony of that Union, and anxious only to escape the fangs of despotism, the good people of this commonwealth are regardless of censure or calumniationâ⬠¦ (Encyclopedia of American History Documents 457) The Kentucky Resolution claims the right of nullification, that nullification was described as an action to be taken by several states that formed the Constitution. The Kentucky document was a follow up to the Virginia document; Virginia joined Kentucky in the protest of the Alien and Sedition Acts. The Kentucky Resolution served as a more serious protest against the acts, as the Virginia Resolution served the purpose of showing the government that the public did not agree with the acts. The acts were unaffected by the Virginia and Kentucky Resolutions and the acts were still enforced. A modern day example of the Alien and Sedition Acts would be after September 11, 2001. The government used the acts to contain possible foreign criminals or men thought to be a part of the terrorist group that committed the crime. The acts were used when the United States held the men from the Boston hotel on suspicion that they were a part of the tragedy. After the two men were arrested and contained by the F. B. I. , they were given a fair trial and found guilty by the evidence against them. In the events that followed the terrorist act the government had to take fast action in bringing the culprits to justice; the Alien and Sedition Acts played a part in helping the government of the United States reach some of their objectives. Even till this day people criticize or assume foreigners such as Middle-Eastern people as a threat to society especially in terms of them being in the United States. People cringe when they see Middle-Eastern people. I know I do. You just donââ¬â¢t know if they have a bomb or a weapon on them and it scares you. Ever since 9/11, people worry about getting on planes with Middle-Easterners or even being near them makes you cringe and become scared because you donââ¬â¢t want that incident to happen to you or to the society. Itââ¬â¢s scary to think about, but to the extremes that the Alien and Sedition Acts were enforced is beyond severe. But, if you feel as though there is an eminent threat to your country or to people it is your job or priority to take action. If the person is a possible foreign criminal or thought to be in a terrorist group based on suspicion, etc. Give them a fair trial and if theyââ¬â¢re guilty or not guilty at least you were being aware and trying to make this country a safer place to live. This was a very controversial debate during the time of John Adams presidency and the Federalist Party. In my opinion the Alien and Sedition Acts are abridging the freedom of speech. These were radical decisions that were made by John Adams and were very harshly enforced on the aliens. The Alien and Sedition Acts were a threat to foreigners coming into the United States and stood no chance of staying in the nation for long with these acts being enforced, which is both malicious and lack apathy on immigrants. Even with the Alien and Sedition Acts being appealed we still have certain requirements for foreigners moving into the United States and we as a nation still have suspicion and still express a since of the Alien and Sedition Acts of foreigners after the devastation on 9/11.
